Attorney Referral Program Terms and Conditions

Marble PC and Marble Law LLC (collectively, "Marble," “Us” or “We”) offers attorneys (“Referrer” or “You”) the opportunity to participate in its client referral program (the “Program”).

By participating, You agree to use the Program as specified in these Terms and Conditions (the “Terms”) and agree to be bound by these Terms and Conditions. By submitting a referral, You agree and reasonably believe Marble and the co-counsel who will represent the client (if not you) are competent and equipped to handle the matter.

A. Program Participation, Generally:

Campaign is available in the jurisdictions where Marble operates. To participate, Referrers log into their Marble Home and follow on-screen instructions to refer potential clients (“PC(s)”) to Marble by entering the PC’s client’s contact information and initial case details.

Submission alone will not warrant Marble paying any referral bonus. An “Eligible Referrer” (as defined below) may receive a referral bonus of up to $300 (“Reward”) for each “Qualified Referral” (as defined below). To receive the Reward,

Referrers must satisfy all Eligible Referrer requirements; and
Referred PCs must meet all Qualified Referral requirements.

B. Eligible Referrer; Requirements

Only Eligible Referrers may qualify to receive the Reward. To be an “Eligible Referrer(s)” you must meet all of the following criteria:

Be a current co-counsel with Marble as of the day of referral submission and have signed the Co-Counsel Agreement.
Obtain the referral’s consent to be contacted by Marble by telephone or email, prior to sharing the referral’s contact information.
Agree to assume joint responsibility for the referred PC’s matter by signing the client engagement letter (“Marble Agreement”);
Comply with state-specific requirements as outlined below:

For Eligible Referrers in Arizona

Referring attorneys must cosign the Marble Agreement letter for referred clients.

For Eligible Referrers in California

Referring attorneys must cosign the Marble Agreement letter for referred clients.

For Eligible Referrers in Colorado

Referring attorneys:

Must co-sign the engagement letter for referred clients.
Agree to assume joint responsibility for the referred client but do not need to play an active role in the case.
Agree the attorney handling the case can provide competent representation to the client.

For Eligible Referrers in Florida

Referring attorneys:

Must co-sign the engagement letter for referred clients.
Must also be available for consultation with the referred client, which means reasonably responding to client’s emails if they reach out to them directly for consultation.
Understand and agree if the attorney to whom the case is referred to breaches ethics rules, the referring attorney may be responsible for their conduct in the event that they ordered or gave consent for the conduct.

For Eligible Referrers in Georgia

Referring attorneys:

Must co-sign the engagement letter for referred clients.
Agree to assume joint responsibility for the referred client but do not need to play an active role in the case.

For Eligible Referrers in Illinois

Referring attorneys:

Must co-sign the engagement letter for referred clients.
Agree to assume joint responsibility for the referred client but do not need to play an active role in the case.

For Eligible Referrers in Maryland

Referring attorneys:

Must co-sign the engagement letter for referred clients.
Agree to assume joint responsibility for the referred client but do not need to play an active role in the case.

For Eligible Referrers in Michigan

Referring attorneys need to co-sign the engagement letter for referred clients. Shared responsibility for the client is not required.

For Eligible Referrers in New York

Referring attorneys:

Must co-sign the engagement letter for referred clients.
Agree to assume joint responsibility for the referred client but do not need to play an active role in the case.
Understand and agree if there are any issues arising from the representation, the referring attorney may be held vicariously liable for misconduct of the attorney handling the case.

For Eligible Referrers in Texas

Referring attorneys:

Must co-sign the engagement letter for referred clients.
Agree to assume joint responsibility for the referred client but do not need to play an active role in the case.
Agree to ensure adequacy of representation by including sufficient details of the referred client's matter and referring them to a competent attorney.
Agree to monitor the matter throughout the representation and ensure that the client is informed of anything relevant. This means responding to client questions directed to the referring attorney and assisting the lawyer handling the case when necessary. In light of this requirement, the referring attorney is NOT required to attend all hearings or receive all copies of correspondence.

C. Qualified Referrals:

Each “Qualified Referral(s)” meets all of the following specific conditions, including:

Have a legal matter in the jurisdiction(s) where Marble operates as of the day of the referral submission.
Have consented to the referral process and agree to receive phone and SMS communications from Marble.
Agree to be represented by Marble and sign the Marble Agreement.
Is not a former Marble client previously represented by the referring attorney. And,
Has not been engaged with Marble (i.e. signed up for an intake call, completed an LSS, etc.) within the last nine (9) months.

D. Earning Rewards; Payout:

For each Qualified Referral, the Eligible Referrer will receive a Reward of $300.00 USD, subject to Marble’s verification and review.

Payment will be dispersed during the Eligible Referrer's next payout, thirty (30) days after the case is closed/won.

Rewards are subject to verification. Marble may delay or refuse Rewards for fraudulent, prohibited, or suspicious activity, in its sole discretion.

E. Privacy

Referrers' participation requires submitting personal information, handled according to Marble’s Privacy Policy.

F. Liability:

Referrers agree to indemnify Marble against claims arising from Program participation.

Marble disclaims liability for various matters outlined in this section.

For Illinois, Colorado, Georgia, Maryland, and New York: Referrers understand and agree they may be vicariously liable for the conduct of the attorney who does the work.

G. Applicable Law; Arbitration; Class Waiver; and Waiver of Jury Trial:

Disputes are resolved under California law through arbitration. Referrers waive jury trial and class action participation.

H. Additional Terms:

Referral codes (if applicable) should not be published or distributed on commercial websites (such as coupon websites, blogs, etc). Referrers are prohibited from “spamming” anyone with referral invitations. This includes mass emailing, texting or messaging people you do not know or using automated systems or bots through any channel to distribute your referral link.

These Terms constitute the Entire agreement. Marble's failure to enforce any provision does not waive its right to do so later.

I. Disclaimer of Warranties

Referrers understand and agree that this Program is also subject to our Terms of Use, as applicable, and nothing herein should be interpreted as a modification or waiver of Warranty.

REFERRERS AND PROSPECTIVE REFERRERS EXPRESSLY UNDERSTAND AND AGREE THAT: (A) YOUR USE OF THE REFERRAL PROGRAM IS AT YOUR SOLE RISK, THE REFERRAL PROGRAM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND MARBLE EXPRESSLY DISCLAIMS ALL WARRANTIES, CONDITIONS AND TERMS (COLLECTIVELY, "PROMISES") OF ANY KIND, WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW OR CUSTOM, INCLUDING, BUT NOT LIMITED TO, PROMISES AS TO PRODUCTS OR SERVICES OFFERED THROUGH THE USE OF THE REFERRAL PROGRAM, IMPLIED PROMISES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (B) MARBLE MAKES AND GIVES NO PROMISE THAT (i) THE REFERRAL PROGRAM WILL MEET YOUR REQUIREMENTS, (ii) BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS OBTAINED FROM THE USE OF THE REFERRAL PROGRAM WILL BE ACCURATE OR RELIABLE, AND (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE REFERRAL PROGRAM WILL MEET YOUR EXPECTATIONS.

J. Modifications

Marble reserves the right to modify these Terms at any time, at its sole discretion. Marble may also, in its sole discretion, change, cancel, suspend, or modify any aspect of the Referral Program without notice. Continued participation in the Referral Program after any modification shall constitute consent to such modification. Marble also reserves the right to disqualify any clients or prospective clients at any time from participation in the Referral Program if we have a good faith belief that they have violated any of the Terms.
